Terms and Conditions of Sale

1. Seller identification

2. Purpose and products

These Terms govern the sale of digital content not supplied on a tangible medium: engine calibration files (original files, known as “Original / Stock”, optimised “Stage 1, 2, 3” files and associated options) as well as “DAMOS” definition files. Each product page states the vehicle and/or the control unit concerned (manufacturer, type, hardware reference, and software version where available).

3. Prices

Prices are shown in euros. VAT not applicable, article 293 B of the French General Tax Code (where relevant, according to the seller's tax regime in force). The applicable price is the one displayed on the product page at the time of the order.

4. Ordering and payment

Payment is made online through Stripe (bank cards and the methods offered at the time of payment). The order is firm as soon as payment is validated. The seller stores no bank card data.

5. Delivery

Delivery is immediate: once payment is validated, a download link is displayed. That link is valid for 24 hours and limited to 5 downloads. Should you run into difficulty (expired link, failed download), contact us with your proof of payment and a new link will be provided.

6. Right of withdrawal, returns and exchanges

In accordance with article L221-28 13° of the French Consumer Code, the right of withdrawal cannot be exercised over digital content not supplied on a tangible medium where performance has begun with the consumer's prior express consent and express waiver of their right of withdrawal. By validating the order, the customer requests immediate delivery of the file and expressly waives their right of withdrawal.

Returns and exchanges. As the files are downloaded digital content, no physical return is possible and no return fee is charged. For 30 days from purchase, the seller replaces free of charge any file that is defective (unreadable, corrupted, incomplete) or does not match the ECU reference and software version stated on the product page: a corrected file, or the file that actually matches the customer's ECU, is supplied. This replacement is the default remedy. Under the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code), a refund is issued only where replacement proves impossible or fails. No replacement or refund is due, however, where the file matches what was ordered and the customer has changed their mind, has selected a vehicle or ECU that is not theirs despite the references displayed, or has used the file contrary to article 7.

7. Use of the files — liability

The files sold are technical data intended for informed users (professionals or enthusiasts equipped with suitable tools). It is for the customer to:

• check the exact match between the file (control unit reference, software version) and their vehicle before any use;
• keep a backup of the original file from their control unit before any write operation;
• ensure that the intended use complies with the applicable regulations (some settings are reserved for use away from roads open to public traffic: competition, track, export).

The seller cannot be held liable for non-compliant use, for a handling error while writing to the control unit, or for use contrary to the regulations in force in the country of use.

8. Intellectual property and licence of use

The sale grants the customer a right to use the file for their own purposes (or those of their workshop). Reselling, redistributing or sharing the files as they stand is prohibited.

9. Complaints

Any complaint may be sent to [email protected]. Dacodac Performance undertakes to acknowledge receipt within 5 working days and to reply within 30 days.

10. Governing law

These Terms are governed by French law. Failing an amicable settlement, the French courts shall have jurisdiction. These provisions apply without prejudice to the mandatory provisions protecting the consumer in their country of residence, which cannot be derogated from.
